Nairobi: A Moi University student, recently acquitted in a case in which he had been charged with the offence of publishing a picture allegedly depicting President William Ruto in a coffin, has secured yet another legal win against the state.

On Wednesday, February 25, the High Court issued temporary orders restraining the Directorate of Criminal Investigations (DCI) and other parties from transmitting or sharing the personal data of the student, David Ooga Mokaya.

High Court Judge Bahati Mwamuye issued the restraining orders pending the hearing and determination of an application filed by lawyers Danstan Omari, Martina Swiga and Shadrack Wambui on behalf of the student.

In his orders, Justice Mwamuye directed the state to stop forthwith sharing any information on Mokaya with any other party.

“A conservatory order be and is hereby issued restraining the respondent and the Interested parties, jointly and severally, and whether directly or through their employees, servants, agents, or related entities; from transferring, sharing, disseminating, or howsoever otherwise divulging to any unauthorized person/party any of the petitioner’s personal data, subscriber information, call and/or location information/records, metadata, or such other information arising from the use on any telephonic or data device or service maintained by the respondent without either the petitioner’s express written consent or either a valid court order issued by a court of competent jurisdiction or the reliance of an express provision of a written law permitting the same,” read part of the order seen by TUKO.co.ke. Why David Mokaya wants KSh 200m in compensation Mokaya, who was on Wednesday, February 19, cleared of charges of allegedly posting a photo of President Ruto, has since filed a case in which he is seeking KSh 200 million in compensation for alleged violation of his fundamental rights.

Source: UGC In court papers that TUKO.co.ke has, the fourth-year university student argues that his right to privacy was infringed after a telecommunication company allegedly granted detectives access to his personal data without a court order.

He believes the action was unlawful and unconstitutional.

Mokaya was arrested on November 18, 2024, after which he was charged with publishing false information about the head of state on social media. He had denied the charges before the court and was consequently acquitted for lack of evidence.

How fake Ruto post case affected David Mokaya’s education Previously, TUKO.co.ke, reported that Mokaya had narrated to the court how the case had affected his studies.

Lawyer Omari had told the court that the case had not only interfered with his client’s studies, but it had also affected his mental focus.

The student had initially failed in his bid to ask the court to terminate the case, with the prosecution insisting on a full trial.
