Source: Twitter His remarks came moments after the court delivered one of the most anticipated political judgments in recent years, denting hopes that Gachagua and his allies had that it would overturn his removal from office.

The judgment was a major setback for the former deputy president, whose camp had been banking on a favourable verdict to revive his political fortunes and strengthen his ambitions ahead of the 2027 General Election.

While the court found that Gachagua’s constitutional rights had been violated during the Senate proceedings, the judges nevertheless upheld Parliament’s decision to remove him from office.

The judges ruled that senators breached Gachagua’s right to a fair hearing after declining to adjourn proceedings despite his illness.

As a result, the court awarded the Democracy for the Citizens Party (DCP) leader KSh 50 million in compensation to be paid by the Senate.

However, the bench dismissed most of the arguments presented by Gachagua and his co-petitioners, finding that the overall impeachment process complied with constitutional requirements.

The court also cleared the way for Deputy President Kithure Kindiki to continue serving in office, rejecting challenges to both the impeachment process and the succession process that led to his appointment.

The outspoken senator made the remarks on Monday, June 8, shortly after a three-judge bench upheld Gachagua’s impeachment while at the same time awarding him KSh 50 million in damages over violations of his right to a fair hearing during the Senate proceedings.

In a statement shared after the ruling, Thang’wa questioned what he viewed as contradictions in the court’s findings.

“This judgment must have been generated by AI. How can a court find that an individual’s rights were violated, award KSh 50 million in compensation, yet still hold that the impeachment process was flawless? Anyway, the next stop is the Court of Appeal. That is the lifeline. Na hiyo KSh 50 million, pea Kasongo! The Wantam movement continues,” he stated. How did court rule in Gachagua’s case? As earlier reported, one of the key arguments advanced by Gachagua’s team was that lawmakers had already predetermined the outcome before the impeachment hearings began.

The judges, however, found no objective evidence to support allegations of bias or predetermination during the 2024 process.

According to the court, political opinions held by legislators do not automatically amount to unconstitutional bias, provided the constitutional process is followed.

Gachagua’s supporters had argued that Kenyans were given insufficient time to examine the allegations against him and submit their views.

However, the court found that the National Assembly had provided adequate notice through newspaper advertisements and multiple participation channels, thereby satisfying constitutional requirements.
