The High Court has deferred the plea taking of Kithuka Musyimi, the prime suspect in the murder of a General Service Unit (GSU) officer attached to State House, after the prosecution revealed that his mental assessment report was not yet ready.
When the matter came before Justice Diana Kavedza on Thursday, November 13, 2025, prosecutors told the court that the report, necessary before Musyimi can take a plea of murder, would be ready within two weeks.
Justice Kavedza stressed that the mental evaluation was crucial in determining whether the accused was mentally fit to stand trial.
“We do not have the mental assessment report. Without it, we will not know whether your client is fit to plead,” the judge said. “We will therefore give a further mention on November 27 for the plea.”
To ensure fair representation, the court appointed lawyer Martin Nabende to act for Musyimi during the proceedings. The judge further directed that once the report is filed, both the prosecution and defence should be notified before the next mention date.
The prosecution, led by a State counsel, confirmed that the mental examination is already in progress and that efforts are being made to fast-track the process. Meanwhile, Musyimi remains in custody as officials finalize the assessment.
Musyimi is accused of murdering GSU officer Ramadhan Khamisi, who was stationed at State House Gate D along Dennis Pritt Road in Nairobi, an incident that shocked the country and prompted a high-level investigation.
