The Nigerian Bar Association (NBA), Sokoto Branch, through its Human Rights Committee, is pleased to inform the public of a landmark judgment delivered by the Honourable Justice Kibura I. Ahmad of the Sokoto State High Court in the case of Hizbullahi Nasiru & 10 Others v. Isah Idris Marafa Esq. (Judge of the Sokoto State Environmental Sanitation Mobile Court) & 2 Others.
The suit, filed for judicial review by the Human Rights Committee of the NBA Sokoto Branch, challenged the arrest, trial, conviction, and sentencing of the Applicants by the Sokoto State Environmental Sanitation Mobile Court. The Applicants had been arrested and convicted for allegedly participating in the #EndBadGovernance protest that took place across Nigeria in 2024.
In a well-considered judgment, the High Court quashed both the conviction and the sentence imposed by the Mobile Court. Furthermore, the Court ordered the Registrar of the Mobile Court to refund all fines previously paid by the Applicants in connection with the unlawful conviction.
This decision reaffirms the fundamental rights of citizens to be tried by a court of competent jurisdiction and to be accorded a fair hearing during trial. It also reinforces the judiciary’s role as the last hope of the common man and as a guardian of constitutional liberties.
The NBA, Sokoto Branch, commends the Sokoto State Judiciary for this courageous judgment and for its unwavering commitment to upholding the rule of law and defending the rights of citizens across the state.
